Education plays a key role in the development of an individual and a Nation. It is contribution to the growth to the human civilization is only next to mother’s lap. In a democratic society, fruits of democracy cannot be realized without the removal of ignorance of the people which stem to a large extent from illiteracy. This is besides the higher purpose which education in any organized and free society may strive to achieve.

Education is extremely important for human resource development and thus for social and economic development of the country. A right to education is well recognized human right because a human right is nothing but a basic right to which every human being should have. Right to education is co-related with human right in the sense that without education the life cannot be a dignified life and this is the basic notion of human right that a person should be a right to be a human.

John Stuart Mill, in his Principles of Political Economy and Liberty, argued that since education was necessary for the child to fit him to perform his part well in life, parents are obligated to provide food for its body. Education was necessary for the members of the community in general who are liable to suffer seriously from the consequences of ignorance and what of education in their fellow citizens. For Mill, education for the poor is essential for self improvement, social mobility and citizenship, reflecting his own egalitarian socialist and democratic philosophy. Because of that, gives a proper education to a child should be a double duty of the parents, towards the children themselves and towards the society as a whole.

Unfortunately, in a world full of social ills and societal needs, there is still a lot of children who didn’t get an adequate education. One of its causes comes from the situation of educational neglect, the phenomenon which is rarely got a big attention from global society. It is in this context that the research paper is to describe the problem of educational neglect with the legal perspective on the right to education. The briefly structures of this paper are:
